This Privacy Notice (“Notice”) describes Equineer Inc.’s (“Equineer,” “we,” “us,” or “our”) practices regarding the collection, use and disclosure of your personal information that we collect via the theponyapp.com website, applications, data storage (including backup and recovery repositories), services and tools, and any other website on which this Notice is posted or linked (“Equineer Services”). By using Equineer Services, you accept this Notice and agree to the collection and use of your personal information in accordance with this Notice and subject to the applicable state and federal laws of the United States.

What personal information we collect from you

We collect information from you when you use Equineer Services. The information that we collect may include the following:

  • contact information, such as your name, address, phone number, email address, username, password, and other similar information;
  • photos that you post using Equineer Services;
  • detailed information on horses you own or have access to, including name, national and international registration numbers, microchip numbers, medical history, and financial records;
  • questions, comments, ideas, feedback, materials or other content you provide to us; and/or
  • any other information you provide to us when you interact with us and Equineer Services.

What personal information we collect automatically

When you use Equineer Services, we also collect information sent automatically to us by your computer, mobile phone or other access device. The information sent to us may include your computer IP address, unique device identifiers, the type of operating system you’re using, your location or GPS/geo-location, mobile network information, standard web log data and other information. Web log data includes the browser type you’re using and traffic to and from our site. We may use third-party analytics tools, such as Google Analytics, to collect this information. 

We may receive information about you from third parties, such as certain information about your use of Equineer Services if you access Equineer Services through a third-party connection or log-in (e.g., through Facebook). We may also collect your personal information from commercially or publicly available sources.

How we use Cookies

When you use Equineer Services, we (including companies we work with) may place small data files on your computer or other device. These data files may be cookies, pixel tags, or other local storage provided by your browser or associated applications (“Cookies”). We use Cookies to: recognize you as a customer; customize the Equineer Services and content to improve your experience; help ensure that your account security is not compromised; mitigate risk and prevent fraud; and to promote trust and safety across Equineer Services.

You are free to decline our Cookies if your browser or browser add-on permits, but doing so may interfere with your use of the Equineer Services. Refer to the help section of your browser, browser extensions, or installed applications for instructions on blocking, deleting, or disabling Cookies.

How we use the personal information we collect

Our primary purpose in collecting personal information is to provide you with a secure, smooth, efficient, and customized experience. We may use your personal information to:

  • provide Equineer Services and customer support;
  • enhance or improve Equineer Services;
  • connect you with relevant clients or businesses;
  • process and analyze transactions and send you notices about your transactions;
  • determine your location and the location of merchants, and to correlate your location with transaction activity;
  • verify your identity;
  • prevent potentially prohibited or illegal activities or otherwise secure your personal information, and enforce our Terms of Use;
  • customize, measure, and improve the Equineer Services and the content, layout, and operation of our website and application;
  • create new tools, analytics, social graphs and algorithms;
  • conduct academic and social (behavioral) research, including publishing reports, academic and white papers;
  • deliver service update notices and promotional offers; and/or
  • communicate with you.

How we share personal information with other parties

We may share your personal information with:

  • other users who use Equineer Services (i.e., sharing of posts and pictures);
  • third-party service providers to perform services on our behalf, including the maintenance and support of Equineer Services and payment processing;
  • law enforcement, government officials, or other third parties as required by law or pursuant to a subpoena, court order, or other legal process or requirement; or when we believe, in our sole discretion, that the disclosure of personal information is necessary to prevent physical harm or financial loss, to report suspected illegal activity or to investigate violations of our Terms of Use.
  • credit bureaus and collection agencies to report account information, as permitted by law;
  • other business entities in connection with the sale or transfer of all or a portion of our business or assets to a third party; and/or
  • Equineer may share anonymous information with third party partners for market research purposes.

How you can restrict Equineer from collecting or sharing your personal information

Equineer maintains your preferences for use, collection, and sharing of information, including how we contact you. Some federal and state laws allow you to restrict the sharing of your personal information in certain instances. You can change your preferences by emailing support@theponyapp.com indicating that you no longer wish to receive marketing communications. Alternatively, you may opt out of our email communications by tapping “unsubscribe” and the bottom of any mass email sent by Equineer.

How you can access or change your personal information

You can review and edit your personal information at any time by logging in to your account and reviewing your account settings and profile. To request to close your Equineer account, you must put the statement “Delete Account” in the body of your request, as well as your name, street address, city, state, and zip code. If you close your Equineer account, we will mark your account in our database as “Closed,” but may retain personal information from your account to collect any fees owed, resolve disputes, troubleshoot problems, assist with any investigations, prevent fraud, enforce our Terms of Use, or take other actions as required or permitted by law. Likewise, if your account or membership is terminated or suspended, we may maintain some information to prevent re-registration.

How we protect and store personal information

We store and process your personal information on our servers in the United States. We maintain reasonable technical, physical, and administrative security measures designed to protect the security of your personal information against loss, misuse, unauthorized access, disclosure, or alteration. It is your responsibility to make sure that your personal information is accurate. You should promptly update your personal information if it changes or becomes inaccurate. We retain information as long as it is necessary and relevant for our operations, typically for as long as a user has an account, though in some instances information may be stored after an account is closed. Notice to California residents

Residents of the State of California may request a list of all third parties to which our online service has disclosed certain personal information (as defined by California law) during the preceding year for those third parties’ direct marketing purposes.  If you are a California resident and want such a list, please contact us at support@theponyapp.com.  For all requests, you must put the statement “Your California Privacy Rights” in the body of your request, as well as your name, street address, city, state, and zip code.  In the body of your request, please provide enough information for us to determine if this applies to you.  You need to attest to the fact that you are a California resident and provide a current California address for our response.  Please note that we will not accept requests via the telephone, mail, or by facsimile, and we are not responsible for notices that are not labeled or sent properly, or that do not have complete information.

California Business & Professions Code Section 22575(b) (as amended effective January 1, 2014) provides that California residents are entitled to know how Equineer responds to “Do Not Track” browser settings.  Equineer does not currently take actions to respond to Do Not Track signals because a uniform technological standard has not yet been developed.  We continue to review new technologies and may adopt any particular technology standard at some point in the future.  

Children’s privacy

The Site is a general audience site and it is not intended for children under the age of 13. We do not knowingly collect personal information via our websites, applications, services, or tools from users in this age group.

Notification regarding updates

From time to time, we may update this Notice. We may notify you about material changes in the way we treat personal information by placing a notice on the theponyapp.com website and The PONYAPP iOS application.
